STATE of CONNECTICUT

Executive Order No. 31

WHEREAS, the 2009-2010 fiscal year for the State of Connecticut commences July 1, 2009; and

 

WHEREAS, there is no approved appropriations act for the 2009-2010 fiscal year; and

 

WHEREAS, the State is thus confronted with a severe financial emergency; and

 

WHEREAS, Article Fourth, Section 5 of the Constitution of the State of Connecticut vests the supreme executive power of the State in the Governor; and

 

WHEREAS, Article Fourth, Section 12 of the Constitution of the State of Connecticut requires that the Governor “shall take care that the laws be faithfully executed;” and

 

WHEREAS, Section 3-1 of the Connecticut General Statutes authorizes the Governor to “take any proper action concerning any matter involving the enforcement of the laws of the State and the protection of its citizens;”

 

NOW, THEREFORE, I, M. Jodi Rell, Governor of the State of Connecticut, by virtue of the authority vested in me by the Constitution and Statutes of the State of Connecticut, do hereby FIND, ORDER and DIRECT:

 

1.      That an emergency exists due to the lack of an approved appropriations act for the fiscal year commencing July 1, 2009, as required by law;

 

2.      That the emergency poses a direct and imminent risk of harm to the preservation of order, the administration of justice and the protection of the public health and safety;

 

3.      That it is therefore necessary and proper that the Governor provide for the continuing operations of the State government in the absence of an approved appropriations act;

 

4.      That all expenditures for the period from August 1, 2009 through August 31, 2009 or the date of approval of an appropriations act for the fiscal year commencing July 1, 2009, whichever occurs first, shall be in accordance with the allotments for the month of August 2009 which are appended to this executive order;

 

5.      That all department heads and executive branch personnel shall limit purchases of goods to those that are essential to governmental functions;

 

6.      That all department heads and executive branch personnel shall limit the purchase of services pursuant to personal service agreements to those that are necessary for the provision of direct care, the administration of justice and the protection of the public health and safety, provided that any such purchase shall be approved in advance by the Office of the Governor and the Office of Policy and Management;

 

7.      That all department heads shall utilize personnel and other resources in an effective and efficient manner, giving priority to programs that provide direct care services, administer justice and protect the public health and safety; and

 

8.      That department heads are hereby authorized to perform all otherwise lawful acts necessary to effectuate this order.

 

 

 

This order shall take effect on August 1, 2009 and shall expire on August 31, 2009 or upon the approval of an appropriations act for the fiscal year commencing July 1, 2009, whichever occurs first.
