Governor

Executive Order No. 19

        WHEREAS, the General Assembly has declared that it is the policy of the State to conserve, improve and protect its natural resources and environment and to control air pollution in order to enhance the health, safety and welfare of the people of this state; and

       WHEREAS, despite the best efforts of the State, levels of air pollution continue to pose public health problems for Connecticut residents and a threat to our natural resources, such as Long Island Sound; and

       WHEREAS, the state Department of Environmental Protection has established a regulatory framework to substantially reduce emissions of nitrogen oxides within Connecticut and throughout the Northeastern United States and is pursuing additional reductions of nitrogen oxides and various air pollutants in regional cooperation with our sister states of Delaware, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Vermont and the District of Columbia; and

        WHEREAS, all major sources of air pollution located within Connecticut, including fossil fuel fired power plants, contribute to air pollution within the State and throughout New England;

        WHEREAS, all major sources of air pollution, including fossil fuel fired power plants, have done much to reduce air emissions, but can reduce emissions even further in a cost-effective manner to the benefit of the people of Connecticut and their natural environment; and

        WHEREAS, the Commissioner of Environmental Protection is authorized by section 22a-174 of the general statutes to formulate, adopt, amend and repeal regulations to control and prohibit air pollution throughout the state;

       NOW THEREFORE, I, John G. Rowland, Governor of the State of Connecticut, acting by virtue of the authority vested in me by the Constitution and by the statutes of this State, do hereby ORDER AND DIRECT:

1. That the Commissioner of Environmental Protection proceed with all due haste to adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, limiting air pollution from the sixty-one emission units in the state of Connecticut that are subject to the requirements of section 22a-174-22b of the Regulations of Connecticut State Agencies, as may be amended; and
2. That such regulations, by May 1, 2003, shall require the owners and operators of such emission units to:
(A) reduce annual sulfur dioxide emissions by an amount 30 to 50% greater than current commitments through the establishment of appropriate reduction targets and the implementation of control strategies designed to protect natural resources, reduce acid deposition and further protect public health, and
(B) reduce annual nitrogen oxide emissions by an amount 20 to 30% greater than current commitments through the establishment of appropriate reduction targets and the implementation of control strategies designed to protect natural resources, reduce acid deposition, reduce nitrogen deposition, reduce eutrophication and further protect public health; and
3. That any regulations adopted pursuant to this Order shall include the use of market-based incentives and a system of creditable emission allowances or credits to foster early, meaningful and cost-effective emission reductions. Such system shall maximize the generation and use of locally created allowances or credits, to the extent practicable, to create a net air quality benefit for the people of Connecticut; and
4. That any regulations adopted pursuant to this Order, to the extent such regulations incorporate fuel sulfur limits applicable to emission units in addition to those identified in Paragraph 1 of this Order, may authorize the Commissioner of Environmental Protection to phase-in such sulfur dioxide emission standard for any such owner or operator of an individual fuel burning unit, and
5. That any regulations adopted pursuant to this Order may authorize the Commissioner of Environmental Protection to temporarily suspend any fuel sulfur requirements upon making a finding that the availability of fuel which complies with such requirements is inadequate to meet the needs of commercial or industrial fuel users in this state and that such inadequate supply constitutes an emergency, provided that the Commissioner shall specify in writing the period of time such suspension shall be in effect; and
6. That this Order not be construed in any way as limiting the authority of the Commissioner of Environmental Protection to impose emission reduction requirements more stringent than those set forth above or the authority of the Commissioner to enter into regional agreements to effectuate emission reduction requirements on a broader, regional basis; and
7. That this Order shall take effect immediately.
