GOVERNOR

 

EXECUTIVE ORDER NO. 9

 

WHEREAS, Broadwater Energy LLC has proposed to construct and operate a floating storage and regasification unit for liquefied natural gas in Long Island Sound (“Unit”); and

 

WHEREAS, the Unit, while physically located in the waters of the State of New York and eleven miles from the Connecticut shoreline, it will be close enough to pose a potential risk of environmental contamination; and

 

WHEREAS, the Unit is estimated to be approximately 1200 feet long and 180 feet wide, with a potential storage capacity of 350,000 cubic meters of liquefied natural gas and 8 billion cubic feet of natural gas, it is apparent that its size and proximity to Connecticut raises concerns for the public health and safety of Connecticut residents; and

 

WHEREAS, in the event that the Unit is compromised and a disaster ensues, the State of Connecticut should be prepared with an emergency response plan to such a sudden, unexpected occurrence which would pose a clear and imminent danger to public safety or requires immediate action to prevent or mitigate the loss or impairment of life, health, property or essential public services; and

 

WHEREAS, to protect the health and safety of the public, a task force shall be established to monitor the construction and operation of this proposed floating liquefied natural gas unit in Long Island Sound; and

 

NOW, THEREFORE, I, M. Jodi Rell, Governor of the State of Connecticut, by virtue of the authority vested in me by the Constitution and Statutes of the State, do hereby ORDER and DIRECT:

 

(1)    There is established a task force to monitor the proposal by Broadwater Energy LLC to construct and operate a floating storage and regasification unit for liquefied natural gas in Long Island Sound to be called the Long Island Sound Liquefied Natural Gas Task Force (“Task Force”).

 

(2)    The Task Force shall:

(a)  analyze the environmental, public health, safety, industrialization, economic and homeland security implications of the proposal on the state and collaborate with the appropriate state agencies; and

      (b) manage the submission of testimony to each regulatory proceeding or body on the proposal conducted by any federal agency or the State of New York. Such testimony shall include recommendations for the safety zones surrounding such unit and for an emergency response plan; and

(c) discuss alternatives to get more liquefied natural gas to the region. 

(3)  The Task Force shall consist of the following members:

      (a)  One member appointed by the Governor who shall be a resident of a municipality located on Long Island Sound;

(b)  One member appointed by the Governor who shall be a member of a nonprofit organization whose primary purpose is protection of the Long Island Sound estuary;

(c)  One member appointed by the Governor who shall represent an environmental nonprofit organization concerned with the preservation, restoration and conservation of environmental resources;

(d)  One member appointed by the President Pro Tempore of the Senate who shall be a Commissioner of the Department of Public Utility Control; 

(e)  One member appointed by the Speaker of the House of Representatives who shall be experienced in the field of natural gas supply and demand and the siting of liquefied natural gas facilities;

(f) One member appointed by the Minority Leader of the Senate who shall have expressed an interest in public service and is an elector of the state;

(g)  One member appointed by the Minority Leader of the House of Representatives who shall be a resident of a municipality located on Long Island Sound;

(h) Six members who shall be the Commissioners of Environmental Protection, Public Health, Transportation, Agriculture, Public Safety and Homeland Security and Emergency Management, or their designees.

 

(4)    The Governor shall appoint the chairperson of the Task Force, from among the members of the Task Force. Such chairperson shall schedule the first meeting of the Task Force, which shall be held no later than sixty days after the effective date of this Order.

 

(5)    For purposes of funding the activities of the Task Force, the Task Force may, as necessary or permitted in accordance with applicable law, to the extent available:  (1) apply for grants from governmental or other sources; (2) accept and expend such grants on behalf of the State of Connecticut through the Office of Policy and Management or such state agencies; or (3) operate within the existing appropriations of participating state agencies. 

 

This Order shall take effect immediately.
