This is the second bill tracking update for the 2017 legislative session. I have listed proposed legislation that is of interest to the disability community under the committee to which the bill was sent. Copies of bills can be accessed on the legislative website at www.CGA.CT.gov

In the 2016 legislative session, Public Act 16-66 was passed and it calls for the closure of the Office of Protection and Advocacy for Persons with Disabilities on June 30, 2017. This Act also requires the Governor to designate a nonprofit entity to take over the “protection and advocacy” duties of the office. The Abuse Investigation Division, which investigates allegations of abuse and neglect of individuals with intellectual disability age 18-59 will state in state government. Legislation will need to be passed to implement the changes. As soon as such legislation is filed I will send out an alert so that everybody can see it.

The “JF Deadline” is the last day the committee has to vote on bills in the possession of the committee. (Bills referred to committees after the deadline have about a week from the referral to take action.)

Proposed H.B. No. 5480 'AN ACT CONCERNING FULL REIMBURSEMENT FOR SPECIAL EDUCATION COSTS', to provide the necessary funding for special education costs incurred by school districts.

Proposed H.B. No. 5483 'AN ACT CONCERNING THE BEHAVIOR MANAGEMENT TRAINING REQUIREMENT FOR CERTAIN SCHOOL PERSONNEL', to reduce costs to school districts related to the mandatory training of school personnel.

Proposed H.B. No. 5484 'AN ACT CONCERNING THE ALTERNATIVE EDUCATIONAL OPPORTUNITY REQUIREMENT FOR EXPELLED STUDENTS', to amend the amount of instructional time that school districts are required to provide to students who have been expelled.

Proposed H.B. No. 5608 ‘AN ACT CONCERNING THE PROVISION OF ALTERNATIVE EDUCATIONAL OPPORTUNITIES FOR EXPELLED STUDENTS BY BOARDS OF EDUCATION’, to retain municipal control over alternative educational opportunities for expelled students.

No. 5610 ‘AN ACT EXPANDING PROTECTION FROM DISCRIMINATION TO CERTAIN STUDENTS’, to (1) include mental disability or physical disability to the provision prohibiting discrimination, and (2) extend application of said section to children under five years of age who are receiving special education and related services pursuant to chapter 164 of the general statutes.

Proposed H.B. No. 5567  'AN ACT CONCERNING THE WAITING LIST FOR THE MEDICAID HOME AND COMMUNITY-BASED WAIVER PROGRAM', to use the savings generated from the privatization of group homes to move one hundred people off of the waiting list for the Medicaid home and community-based waiver program.

Proposed H.B. No. 5643 ‘AN ACT EXPANDING ACCESS TO THE CONNECTICUT HOME-CARE PROGRAM FOR THE ELDERLY’, to expand access to home care for the elderly and avert the need for more costly institutionalization.

INSURANCE AND REAL ESTATE COMMITTEE (deadline 03/16/17)

Proposed S.B. No. 19 'AN ACT REQUIRING HEALTH INSURANCE COVERAGE OF A PRESCRIBED DRUG FOR A CHRONIC CONDITION DURING CERTAIN ADVERSE DETERMINATION REVIEWS', to require health insurance coverage, during certain adverse determination reviews, of a prescribed drug other than a schedule II or III controlled substance for a chronic condition.

Proposed S.B. No. 21 'AN ACT CONCERNING HEALTH INSURANCE COVERAGE OF ORALLY AND INTRAVENOUSLY ADMINISTERED MEDICATIONS', to create equity between orally administered and intravenously administered medications.

Proposed S.B. No. 24 'AN ACT REDUCING THE TIME FRAMES FOR URGENT CARE ADVERSE DETERMINATION REVIEW REQUESTS', to improve access to care.

Proposed S.B. No. 25 'AN ACT REQUIRING HEALTH INSURANCE COVERAGE OF A PRESCRIBED DRUG DURING THE ENTIRE ADVERSE DETERMINATION REVIEW AND EXTERNAL REVIEW PROCESSES', to require health insurance coverage, during the entire adverse determination review and external review processes, of a prescribed drug other than a schedule II or III controlled substance.

Proposed H.B. No. 5133 'AN ACT REQUIRING HEALTH INSURANCE COVERAGE OF JET INJECTORS FOR INDIVIDUALS DIAGNOSED WITH INSULIN-DEPENDENT DIABETES', to require health insurance coverage of jet injectors for individuals diagnosed with insulin-dependent diabetes.

Proposed H.B. No. 5269 'AN ACT CONCERNING HEALTH INSURANCE COVERAGE FOR HEARING AIDS', to require health insurance coverage for hearing aids for individuals with a hearing loss of ninety per cent or greater and to establish a graduated deductible for such individuals.

Proposed S.B. No. 111 ‘AN ACT CONCERNING NOTIFICATION TO SCHOOLS OF PROTECTIVE OR RESTRAINING ORDERS AFFECTING STUDENTS’, to require notice be sent to schools when a student is named in a protective or restraining order.

Proposed S.B. No. 113 ‘AN ACT CONCERNING THE ESTABLISHMENT OF A PROFESSIONAL CODE OF CONDUCT FOR PROBATE COURT CONSERVATORS’, to require the Probate Court Administrator to develop and implement a professional code of conduct applicable to any conservator appointed in a Probate Court matter.

Proposed H.B. No. 5209 'AN ACT ESTABLISHING A DEDICATED DRUG DOCKET IN NEW LONDON COUNTY', to establish a dedicated drug docket in New London County.

Proposed H.B. No. 5441 'AN ACT REQUIRING HEALTH INSURANCE COVERAGE FOR LONG-TERM ADDICTION TREATMENT', to require health insurance coverage for long-term addiction treatment.

Proposed H.B. No. 5542 'AN ACT CREATING A PILOT PROGRAM DRUG DOCKET IN NEW LONDON COUNTY', to establish a pilot program drug docket in New London County.

Proposed H.B. No. 5543 'AN ACT CONCERNING PROBATE COURT AUTHORITY TO ORDER A PERSON TO SUBMIT TO AN INVOLUNTARY MEDICAL EVALUATION', to provide a Probate Court with the authority to order a person with a substance use disorder or mental disability to submit to an involuntary medical evaluation.

Proposed H.B. No. 5651 ‘AN ACT REQUIRING CLERKS OF THE COURT TO PROVIDE NOTICE OF PROTECTIVE ORDERS TO SCHOOLS’, to ensure that the clerk of the court notifies a school system of the existence of a protective order that has been issued relating to a student enrolled at the school or the parent or legal guardian of such student.

Proposed H.B. No. 5654 ‘AN ACT CONCERNING HARASSMENT OF A SERVICE ANIMAL OR USER OF A SERVICE ANIMAL’, to create a new crime of harming or harassing a service animal or an individual while using a service animal.

Proposed S.B. No. 27 'AN ACT INCLUDING CERTAIN MENTAL OR EMOTIONAL IMPAIRMENTS WITHIN THE DEFINITION OF "PERSONAL INJURY" UNDER THE WORKERS' COMPENSATION STATUTES', to expand workers' compensation coverage in certain situations that result in mental or emotional impairment.

PLANNING AND DEVELOPMENT COMMITTEE (deadline 03/27/17)

Proposed H.B. No. 5159 'AN ACT WAIVING THE DOG LICENSE FEE FOR SERVICE ANIMALS', to waive the dog license fee for service animals.

Proposed H.B. No. 5290 'AN ACT AUTHORIZING THE ISSUANCE OF BONDS FOR HANDICAPPED ACCESSIBLE AREAS ON PORTIONS OF EAST MAIN STREET AND PARK AVENUE IN BRIDGEPORT', to enable the city of Bridgeport to build and maintain handicapped accessible areas on portions of East Main Street and Park Avenue.

Proposed H.B. No. 5448 'AN ACT CONCERNING THE COSTS OF REMOVAL AND STORAGE OF PROPERTY OF EVICTED TENANTS AND FORECLOSED PROPERTY OWNERS', to alleviate an unfunded mandate on municipalities with regard to removal and storage of property of evicted tenants and foreclosed property owners.

PUBLIC HEALTH COMMITTEE (deadline 03/29/17)

Proposed S.B. No. 3 'AN ACT CONCERNING THE DONATION OF ORGANS AND BONE MARROW', to promote and facilitate the donation of life-saving organs and bone marrow.

Proposed S.B. No. 28 'AN ACT ALLOWING ADVANCED PRACTICE REGISTERED NURSES TO CONCLUDE THAT A PERSON HAS PSYCHIATRIC DISABILITIES AND IS DANGEROUS TO HIMSELF OR HERSELF OR OTHERS FOR PURPOSES OF CONFINEMENT IN A HOSPITAL FOR PSYCHIATRIC DISABILITIES UNDER AN EMERGENCY CERTIFICATE', to allow advanced practice registered nurses to conclude that a person has psychiatric disabilities and is dangerous to himself or herself or others for purposes of confinement to a hospital for psychiatric disabilities under an emergency certificate.

Proposed S.B. No. 31 'AN ACT REQUIRING PHYSICIANS' OFFICES AND HEALTH CARE FACILITIES TO BE ACCESSIBLE TO PERSONS WITH PHYSICAL DISABILITIES', to assist persons with disabilities in attaining medical care.

Proposed S.B. No. 38 'AN ACT CONCERNING THE PROVISION OF SERVICES TO PERSONS WITH AN INTELLECTUAL OR DEVELOPMENTAL DISABILITY', to prevent disruption of services to persons with an intellectual or developmental disability.

Proposed S.B. No. 39 'AN ACT CONCERNING A PUBLIC-PRIVATE PARTNERSHIP TO PROVIDE QUALITY SUPPORTS AND SERVICES FOR PERSONS WITH INTELLECTUAL AND DEVELOPMENTAL DISABILITIES', to provide continuum of care options, improve jobs and reduce the waiting list for services and supports for persons with intellectual and developmental disabilities.

Proposed S.B. No. 71 'AN ACT CONCERNING THE REDUCTION OF CONCUSSIONS IN YOUTH SPORTS', to reduce the instances of concussions in intramural and interscholastic athletics and other youth sports.

Proposed S.B. No. 85 'AN ACT CONCERNING THE TRAINING OF INDIVIDUALS STAFFING RESIDENTIAL HOMES LICENSED BY THE DEPARTMENT OF PUBLIC HEALTH', to ease the burden placed on certain residential facilities licensed by the Department of Public Health.

Proposed S.B. No. 125 ‘AN ACT CONCERNING NATUROPATHIC PHYSICIANS’, to permit naturopathic physicians to prescribe medication in certain circumstances.

Proposed S.B. No. 127 ‘AN ACT CONCERNING HOSPICE ORGANIZATIONS LICENSED BY THE DEPARTMENT OF PUBLIC HEALTH’, to examine hospice organizations licensed by the Department of Public Health and how they manage end-of-life issues.

Proposed H.B. No. 5163 'AN ACT CONCERNING A PILOT SUPPORTIVE HOUSING PROGRAM FOR PERSONS WITH DEVELOPMENTAL DISABILITIES', to provide supportive housing and easily accessible services to adults with developmental disabilities.

Proposed H.B. No. 5167 'AN ACT PROHIBITING PRIMARY CARE PHYSICIANS FROM PRESCRIBING OPIOIDS', to help prevent the overprescribing of opioids.

Proposed H.B. No. 5170 'AN ACT PROHIBITING THE DISPENSING OF OPIOIDS OUTSIDE OF A HOSPITAL SETTING TO ANY PERSON UNDER THE AGE OF EIGHTEEN', to combat the abuse of opioids.

Proposed H.B. No. 5295 'AN ACT REQUIRING FOOD ALLERGY AWARENESS TRAINING', to improve food allergy awareness in the restaurant business.

Proposed H.B. No. 5323 'AN ACT CONCERNING TRAINING OF LICENSED HEALTH CARE PROFESSIONALS WHO CLEAR STUDENT ATHLETES FOR PARTICIPATION IN SUPERVISED TEAM ACTIVITIES AFTER A CONCUSSION', to strengthen existing student athlete concussion legislation.

Proposed H.B. No. 5379 'AN ACT CONCERNING MENTAL, EMOTIONAL AND BEHAVIORAL HEALTH SERVICES FOR CHILDREN', to strengthen the provision of mental, emotional and behavioral health services to children.

Proposed H.B. No. 5380 'AN ACT CONCERNING THE AVAILABILITY OF EPINEPHRINE IN PUBLIC VENUES', to make emergency epinephrine in cartridge injectors more widely available to people who suffer anaphylactic symptoms in public venues.

Proposed H.B. No. 5383 'AN ACT CONCERNING REPORTING BY PROVIDERS OF MEDICAL CARE TO SENIOR CITIZENS ON INCIDENTS AND COMPLAINTS CONCERNING FRAUD AND ABUSE', to prevent senior citizens from becoming victims of fraud and abuse while receiving medical care.

Proposed H.B. No. 5453 'AN ACT CONCERNING MANDATES REQUIRED UNDER THE AFFORDABLE CARE ACT', to repeal costly health care mandates.

Proposed H.B. No. 5454 'AN ACT CONCERNING AN ENGAGEMENT MODEL OF MENTAL HEALTH CARE', to utilize trained volunteers to improve outcomes and reduce the cost of mental health care in the state.

Proposed H.B. No. 5564 'AN ACT CONCERNING ACCESSIBILITY OF MEDICAL DIAGNOSTIC EQUIPMENT', to require medical diagnostic equipment purchased by health care facilities to meet technical standards for accessibility by persons with disabilities.

Proposed H.B. No. 5565 'AN ACT CONCERNING FUNDS APPROPRIATED TO THE DEPARTMENT OF DEVELOPMENTAL SERVICES', to ensure that unexpended funds originally appropriated to the Department of Developmental Services are not transferred to the General Fund or used for any purpose other than the provision of services to persons with intellectual or developmental disabilities.

Proposed H.B. No.  5666 ‘AN ACT REQUIRING WELLNESS CHECK-INS FOR PATIENTS WITH PRESCRIPTIONS FOR OPIOID ANTAGONISTS’, to require wellness check-ins for patients with a prescription for an opioid antagonist and recovering from opiate addiction.

Proposed S.B. No. 77 'AN ACT REQUIRING PHOTOGRAPHS ON REMOVABLE WINDSHIELD PLACARDS', to require photo identification on removable windshield placards to prevent abuse of such placards.

Proposed H.B. No. 5178 'AN ACT REQUIRING THREE-POINT SEAT SAFETY BELTS FOR SCHOOL BUSES', to require school buses to be equipped with three-point lap and shoulder seat safety belts and to require passengers of a school bus to wear seat safety belts.

Proposed H.B. No. 5181 'AN ACT CONCERNING REMOVABLE WINDSHIELD PLACARDS FOR PERSONS WHO ARE BLIND AND PERSONS WITH DISABILITIES', to require removable windshield placards to bear the name of the person who is blind or person with disabilities for whom the placard was issued and to establish penalties for the abuse of such placards.

Proposed H.B. No. 5183 'AN ACT CONCERNING THE NUMBER OF REMOVABLE WINDSHIELD PLACARDS THAT MAY BE ISSUED TO PERSONS WHO ARE BLIND AND PERSONS WITH DISABILITIES', to permit a blind person or person with disabilities to obtain two removable windshield placards if such person owns two motor vehicles.
