Assigned Counsel are private attorneys who are committed to seeing that all constitutional rights are preserved for persons who are charged with the commission of a crime and who do not have the financial ability to hire an attorney. Assigned Counsel are appointed in individual cases when a conflict of interest requires that an attorney from outside the Division represent the individual.

Assigned Counsel Attorneys enter into annual agreements with the Division of Public Defender Services. These attorneys practice law in all areas of the legal community and further enhance the quality of client representation within the Division. These attorneys are selected by the Division on the basis of their qualifications and experience.

In 2008-09, Assigned Counsel were assigned to 8,494 cases including 7,523 contractual cases. During 2009-10, the Public Defender Services Commission entered into 700 contracts with approximately 301 private attorneys, who agreed to accept Assigned Counsel appointments in adult criminal cases, juvenile criminal cases and habeas corpus masters. Currently, contracts have been executed for a total of 5,968 conflict of interest cases.
