Revised Environmental Condition Assessment Form and Instructions

(Effective June 1, 2009)

The Environmental Condition Assessment Form (ECAF) was developed by DEP, as required by sections 22a-133x and -134a of the Connecticut General Statutes (CGS). The purpose of the form is to provide basic site information to DEP and to the public regarding a site for which a filing has been submitted pursuant to the Property Transfer Program (CGS section 22a-134a) or pursuant to the Voluntary Remediation Program (CGS section 22a-133x). The form is used by DEP to determine whether DEP oversight of the investigation and remediation at a specific site is necessary, or whether a licensed environmental professional (LEP) may verify that site investigation has been performed in accordance with prevailing standards and guidelines and that site remediation has been performed in accordance with the Remediation Standard Regulations, sections 22a-133k-1 through -3 of the Regulations of Connecticut State Agencies (RSRs). The information that staff will review in this process is limited to what is included on the ECAF.

A taskforce was established to revise and update DEP's Environmental Condition Assessment Form (ECAF) and accompanying instructions. The taskforce consisted of five DEP staff. The public review and comment period for the revised ECAF and Instructions was from February 25, 2009 to March 25, 2009, after which DEP considered and incorporated comments, as appropriate.

The previous version of the ECAF was revised to clarify to the certifying party (CP) of a filing and to the LEP what site-specific information DEP is requesting to make an informed decision regarding oversight; to obtain site-specific information needed for the public file; to reduce DEP staff review time by having all pertinent information available; to avoid the need for many attachments; and, most importantly, to alert DEP staff immediately to a potential risk to receptors.
