Connecticut’s Electronics Recycling Law

NOTICE OF INTENT TO ADOPT REGULATIONS REGARDING COVERED ELECTRONIC DEVICES

Pursuant to section 4-168(d) of the Connecticut General Statutes, the Department hereby gives notice of its intent to proceed with the adoption of proposed regulations regarding the collection, transportation, reuse, refurbishment and recycling of covered electronic devices ("CEDs").

The Department of Environmental Protection has prepared a Statement of Reasons in response to the public comment period and public hearing for the regulations to implement Chapter 446n (Covered Electronics Devices) of the Connecticut General Statutes. The statement of reasons lists all comments submitted during the public comment period and public hearing as well as the Department’s response to each comment. As a result of the public comment period and public hearing, the Department has revised the electronic waste regulations.

In July of 2007, the State of Connecticut adopted a new law concerning  the recycling of household electronics.  Codified at sections 22a-629 through 22a-640 of the Connecticut General Statutes, this law enables Connecticut to manage an ever-growing portion of the solid waste stream. According to EPA, electronic waste (E-waste) grew by almost 8% from 2004-2005. Only a small percentage of residential electronics generated in Connecticut is recycled. Under the new E-waste law, residents will have convenient and free opportunities for recycling their computers, televisions and monitors.

Connecticut now joins a growing list of states that have implemented a state program which requires manufacturers to finance the transportation and recycling of computers, monitors and televisions. The Department of Environmental Protection (Department or DEP) will continue to provide updated information to all participants (residents, municipalities, manufacturers, recyclers, retailers) on the details of the program as it becomes available.

Information for Municipalities

Information for Manufacturers
 
Please note: All manufacturers of CEDs must register with the DEP. A manufacturer, who has sold CEDs in the past but sold less than or equal to 100 CEDs in 2007, must register with the DEP, but does not owe a registration fee. A manufacturer, who has sold more than 100 CEDs in 2007, must register with the DEP and pay the initial $5000.00 registration fee.*  The DEP has revised the registration form to clarify any confusion surrounding manufacturers that have sold CEDs in the past but had zero sales in 2007. Manufacturers that have not yet submitted a registration form may download and submit a completed revised form. Please e-mail Tom Metzner if you have any questions or have submitted an incorrect registration.
 

*The manufacturers’ renewal registration fees for 2009 are not due until the regulations have been adopted.  Manufacturers should not submit renewal registration fees for 2009 until directed to do so by the Department.  Monitor this website for new information.

Information for Electronics Recyclers

As noted in the previous section, certain manufacturers of electronics are required to register with DEP and pay certain fees. After the effective date of the E-Waste Regulations issued under Connecticut General Statutes Sections 22a-638 (see below), recyclers will be authorized to receive reimbursement for the transportation and recycling of Covered Electronic Devices that are collected through regional and municipal collection programs.

Information for Retailers

Beginning on January 1, 2010, Connecticut General Statutes Section 22a-634 will prohibit the retail sale of covered electronic devices marketed by manufacturers that have not properly registered with DEP, and paid the required fees. Retailers may consult the list referenced in the "Information for Manufacturers" section of this page to determine which manufacturers and brands have registered with DEP.

E-waste Regulations
 
Section 22a-638 of the Connecticut General Statutes requires the Department to adopt regulations to carry out the provisions of the law.  Throughout the drafting process, the Department sought and received input from manufacturers, recyclers, towns and regional planning agencies regarding the content of the regulations by forming an  E-waste Regulations External Advisory Group. This group met with the department routinely via conference calls from October 2007 to January 2008, with a final face-to-face meeting held on January 14, 2008.  The Department has completed drafting the proposed regulations. See the notice box at the top of this page and the schedule for adopting E-waste regulations for up-to-date information on the status of the adoption process.
