Abatement of Air Pollution

The Commissioner of Environmental Protection originally promulgated the regulations for the abatement of air pollution pursuant to authority granted by section 19-508 of the Connecticut General Statutes. In 1983, the General Assembly re-codified the Commissioner’s grant of authority under Title 22a. Statutory authority to formulate, adopt, amend and repeal regulations for the abatement of air pollution is now found in section 22a-174 of the Connecticut General Statutes.

Furthermore, it should be noted that while all regulations for the abatement of air pollution are enforceable by the State of Connecticut, certain regulatory provisions that are incorporated into the Connecticut State Implementation Plan (SIP) for air quality are also federally enforceable. As such, the United States Environmental Protection Agency may enforce these regulatory provisions. All federally enforceable regulatory provisions are identified in the Connecticut SIP, which is published in title 40 Code of Federal Regulations, part 52, subpart H. 

The Code of Federal Regulations (CFR), if not otherwise indicated in the regulations, is read to mean the CFR as of the date the commissioner issued public notice of intent to adopt such regulatory provision. See GPO Access  where you can retrieve the CFR by citation and year.
