When You Are Required To Contact DEEP
For Permits under CGS Section 22a-430
 
This following information provides a summary regarding when you need to contact the DEEP for issues related to your permit. For complete information about regulatory notification requirements, see State and Federal Regulations RCSA Section 22a-430-3 and 40 CFR Subpart 403.12

When To Notify the Discharge Monitoring Report (DMR) Processing Unit
If you have a violation of a permit limitation, RCSA Section 22a-430-3(j)(11), you must:
  • Immediately take steps to prevent or correct the violation
  • Record the quantity and quality of the discharge
  • Monitor the discharge in accordance with the permit terms
  • You must submit a letter of explanation with your next routine DMR monitoring report that contains the following information:
    • What the violations are
    • Why the violation occurred
    • What corrective actions have been taken and
    • What is being done to prevent recurrence of the violation
    • Notify the WPED verbally and in writing of the violation in accordance with RCSA 22a-430-3(j)(11)(D)
When to Notify WPED 

 
Failure or Malfunction of Monitoring Equipment
 
If you have a failure or malfunction of any monitoring equipment, you must notify the WPED at 860-424-3025 within two hours of the failure or malfunction. If it occurs outside of normal business hours, notify at 860-424-3338, and then at the start of the next business day, follow-up notification at 860-424-3025.
 
You must also submit a report within five days of the failure or malfunction and include the following information:
  • Cause of the problem
  • Duration of the problem (including dates and times)
  • Corrective actions taken to minimize adverse impacts and
  • Plans to prevent recurrence of the problem
 
Bypass of Any or All of the Waste Treatment System 
RCSA Section 22a-430-3(k)(4)
 
You must notify the WPED at 860-424-3025 within two hours of becoming aware of the bypass of any portion of the waste treatment system. If the bypass occurs outside of normal business hours, call DEEP's Emergency Response and Spill Prevention Division at 860-424-3338 and then follow-up notification at 860-424-3025.
 
You must also submit a report within five days of the bypass containing the following information:
  • Cause of the bypass
  • Duration of the bypass (including dates and times)
  • Corrective actions taken to minimize adverse impacts; and
  • Plans to prevent recurrence of the bypass. 
In addition, if you have reason to believe that any effluent limitation specified in the permit may be violated, you must:
  • Immediately take steps to prevent or correct the violation
  • Record the quantity and quality of the discharge
  • Monitor the discharge in accordance with the permit terms
  • Submit monitoring results as a separate report with the next DMR.
Noncompliance with Permit Terms or Conditions
RCSA Section 22a-430-3(j) (11)(D)
 
You must notify WPED at 860-424-3025 and, for sanitary sewer discharges (SPDES), the Superintendent of the receiving POTW within two hours of becoming aware of an actual or anticipated noncompliance with permit terms or conditions. If outside of normal business hours, notify WPED at the start of the next business day. 
 
Permit
Conditions
Surface Water (NPDES)
Exceed twice any permit limit or have an exceedance of any Maximum Daily Limit.
Sanitary Sewer (SPDES) Exceed twice any permit limit
All Permits  Any condition that may endanger human health, the environment, or the operation of a POTW, including sludge handling and disposal
 
You must also submit a report within five days of the actual or anticipated noncompliance containing the following information:
  • Description of the noncompliance
  • Cause of the noncompliance
  • Period of noncompliance (including dates and times)
  • Corrective actions taken and planned to minimize adverse impacts
  • If the noncompliance has not been corrected, how long it will last
  • Plans to prevent recurrence of the noncompliance
You do not need to report less severe exceedances of effluent limitations except in the next monitoring report (DMR).
 
Exceedance or Potential to Exceed the Pollutant Concentration Levels   
RCSA Section 22a-430-3(j)(11)(E) 
 
You are required to notify the WPED at 860-424-3025 within 72 hours and submit a report within 30 days, if you know or have reason to believe that the concentration in the discharge of any listed substance or any toxic substance as listed in Appendix B or Appendix D of RCSA Section 22a-430-3 has exceeded or will exceed the highest of the following levels:
  • A level two times the level specified in the permit application
  • 100 micrograms per liter of a parameter listed in Appendix B or D
  • 200 micrograms per liter for acrolein and acrylonitrile
  • 500 micrograms per liter for 2, 4-dinitrophenol and for 2-ethyl-4, 6-dinitrophenol
  • One milligram per liter for antimony
 
Modification of any Wastewater Treatment System or its Method of Operation for the Purpose of Correcting or Avoiding a Permit Violation
RCSA Section 22a-430-3(i)(3)
 
You are required to notify the WPED at 860-424-3025 of any modification of any wastewater treatment system or its method of operation within two hours of making the change or at the start of the next business day if the change is made outside normal business hours.
 
You must also submit a report describing the changes made and why for review and approval within 30 days of the modification.
 
 
Use of Alternative Collection and Treatment Scheme to Prevent Bypass During Scheduled Maintenance 
RCSA Section 22a-430-3(k)(3)
 
You must notify the WPED at 860-424-3025 not less than 24 hours prior to the use of any alternative collection, treatment, or pre-treatment scheme intended to prevent a bypass during periods of scheduled maintenance.  You must receive prior written approval.
 
 
Submission of Incorrect or Incomplete Information 
RCSA Section 22a-430-3(j)(9)(c)
 
If at any time you become aware that incorrect or incomplete information has been submitted, you must:
  • Notify the WPED at 860-424-3025 within 72 hours.
  • Submit written correct and/or complete information within 30 days.
 
Compliance with Step in Order Schedule
RCSA Section 22a-430-3(j)(11)(c)
 
If a schedule of compliance is included in a permit either directly or indirectly by reference to a separate abatement order, notify the WPED in writing when compliance with each step is achieved.
 
 
 
You must notify the WPED at 860-424-3025 and obtain written approval prior to undertaking any facility expansion or alteration, production increase or process modification if the modification may result in the discharge of any new water, substance or material or increase the quantity or concentration of an existing pollutant beyond permit conditions, or may constitute a new source.
 
You must notify the WPED and obtain written approval prior to undertaking an expansion or significant modification of any wastewater treatment facility or its method of operation unless the change is necessary to correct a permit violation or avoid an imminent permit violation. 
 
All modification requests must be made using the Facility and Wastewater Treatment System Modification form.
