Under authority of Section 26-159a of the Connecticut General Statutes and Section 26-159a-22 of the Regulations of Connecticut State Agencies, the Commissioner of Environmental Protection is authorized to establish or adjust, by declaration, closed seasons, length limits, creel limits, trip limits and trip limit adjustment values in order to comply with interstate fishery management plans adopted by the Atlantic States Marine Fisheries Commission (ASMFC) or the U.S. Department of Commerce. Such changes are implemented after a 10-day notice period.

In accordance with the aforementioned authority, the following fishing regulations will be effective on November 1, 2006.

Winter II Period Commercial Fishery Possession Limits for Scup

From November 1 through December 31, inclusive, the commercial fishery possession limit for scup shall be 6,500 lbs. until 100% of the coastwide quota specified in the plan for this period has been landed, at which time the limit shall be zero pounds;

Possession limits apply to the aggregate of all persons on board the vessel per trip or per day whichever is the longer period of time. Transfer of scup between vessels at sea is prohibited.

As allowed under the ASMFC’s fishery management plan for scup and as specified under U.S. Department of Commerce rules, unused scup Winter I (Jan 1 - Apr 30) quota is rolled over to the Winter II (Nov 1 - Dec 31) period and the possession limits are adjusted to provide opportunity to harvest the quota. This declaration increases the Winter II possession limit in Connecticut from 3,500 lbs. to 6,500 lbs. consistent with those rules.

Quota Period II Commercial Fishery Possession Limits for Spiny Dogfish

From November 1 through April 30, inclusive, the commercial fishery possession limit shall be 600 lbs. until 100% of the coastwide quota specified in the plan for this period has been landed, at which time the limit shall be zero pounds;

Possession limits apply to the aggregate of all persons on board the vessel per trip or per day whichever is the longer period of time. Transfer of spiny dogfish between vessels at sea is prohibited.

The ASMFC fishery management plan for spiny dogfish and U.S. Department of Commerce rules have been amended to allow possession limits 600 lbs. for both the Quota Period I (May 1 - Oct 30) and Quota Period II (Nov 1 - Apr 30). This declaration increases the Quota Period II possession limit in Connecticut from 300 lbs. to 600 lbs. consistent with those rules.
