Party Status in Substantiation Hearings

Policy 
 
Parties to the substantiation hearing are the
  • person substantiated as a perpetrator of abuse or neglect  
  • parent/guardian of a minor substantiated as a perpetrator of child abuse or neglect
  • department. 
NOTICE:  Pursuant to Conn. Gen. Stat. Sec. 17a-101k(i), draft Regulations related to substantiation policy are currently under review. Since this review includes entities outside of the agency, as well as the public, the final version of the Regulations may vary from this Policy. This Policy will be updated when the Regulations are finalized.
 

Presence at the Hearing 
 
The only authorized persons at the hearing shall be
  • the parties
  • authorized representatives or attorneys
  • witnesses, while testifying.
Other persons may be permitted to be present for all or part of the hearing at the discretion of the hearing officer, except that any person who will be a witness shall be excluded from the hearing until his or her testimony is completed.
