DO 373 - (Cingular/Avon) Evidentiary Hearing Continued in New Britain

DOCKET NO. 373
- New Cingular Wireless PCS, LLC (AT&T) application for a Certificate of Environmental Compatibility and Public Need for the construction, maintenance and operation of a telecommunications facility located at the St. Matthew Lutheran Church, 224 Lovely Street, Avon, Connecticut.

The Connecticut Siting Council (Council) announces that the evidentiary hearing for this application will continue at 11:00 a.m. on Wednesday, April 29, 2009, in Hearing Room One, Ten Franklin Square, New Britain, Connecticut.

Before April 23, 2009, all parties and intervenors are strongly encouraged to exchange pre-hearing interrogatories and exchange pre-filed testimony, exhibits, witness lists, and items to be noticed administratively with all other parties and intervenors. The failure of a party or intervenor seeking information to use interrogatories may result in an opposing party or intervenor not having the desired information at the hearing. Moreover, the failure of parties or intervenors to avail themselves of the opportunity to file interrogatories shall not be an excuse for seeking an additional hearing session.

Please note, the Council considers the use of pre-hearing interrogatories to be exceptionally helpful in assurring that evidence of a technical nature is available at the hearing. To save the time and expense of parties, intervenors, all parties and intervenors are encouraged to resolve discrepancies of these items before the hearing. If any parties or intervenors has an objection to an interrogatory and such objection is not resolved prior to the resumption of the hearing, the objecting party or intervenor should bring the relevant information to the resumed hearing. The Council will rule upon the objection.
