RE: DOCKET NO. 428 – New Cingular Wireless PCS, LLC (AT&T) application for a Certificate of Environmental Compatibility and Public Need for the construction, maintenance, and operation of a telecommunications facility located at one of two sites: Roxbury Tax Assessor Parcel ID #32-008 off of Route 67, Roxbury, Connecticut, or 126 Transylvania Road, Roxbury, Connecticut. Continuation of Evidentiary Hearing. Request for Extension.
The Connecticut Siting Council (Council) shall continue the evidentiary hearing for this proceeding on Thursday, December 6, 2012, in Hearing Room One, Ten Franklin Square, New Britain, Connecticut, beginning at 11 AM.
To save the time and expense of parties, intervenors and the public, the Council requests that all parties and intervenors submit additional interrogatories on or before November 15, 2012 so that the hearing can be concluded in a timely manner. All parties and intervenors shall submit their responses to interrogatories and submit additional pre-filed testimony to the Council and all other parties and intervenors on or before November 29, 2012.
The current deadline for the above-mentioned docket is December 31, 2012. Due to the need for a continued hearing and the statutory requirement for a 30-day comment period following the close of the hearing, the Connecticut Siting Council (Council) will need additional time to render a decision. Connecticut General Statute § 16-50p(a) provides, in part, that the Council’s decision shall be rendered, “Not later than one hundred eighty days after the filing of an application for” a telecommunications tower “provided such time period may be extended by the Council by not more than one hundred eighty days with the consent of the applicant.” The Council hereby requests such consent for an additional extension of the decision deadline for 90 days until March 29, 2013.
The applicant’s consent to the requested extension of time shall have the effect of tolling the Federal Communications Commission (FCC) 150-day tower siting timeframe in accordance with Paragraph 49 of the FCC Declaratory Ruling issued on November 18, 2009 (FCC WT Docket No. 08-165).
