BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, December 14, 2017, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Wethersfield, CT 06109

 

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:15am.

Chairman Blando read the Introductory Statement and called the roll call.  Seven appellants were present, three appellant failed to appear. The State Issuing Authority and nine local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, Ms. Gudrun Johnson, Mr. M. Peter Kuck, Chief Carl Rosensweig.

Board Member arrived at 10:40.

Board Members Absent: None

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Ten cases were heard in the following order:

1) Case No. 17-081-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Atty. Ralph Sherman represented the appellant. Sgt. Gotowala represented the local Issuing Authority, Chief Brian Gould, Bristol Police Department.

Motion: Board Member Kuck made a motion to find for the appellant due to his suitability, seconded by Dr. Sledge. .Motion carried unanimously.

10:40:  Atty. Carolyn Futtner arrived

2) Case No. 17-161-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Counsel Joseph Skully represented the local Issuing Authority, Chief James Wardwell, New Britain Police Department with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and order New Britain to issue the permit.

3) Case No. 17-192-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.. Lt. Keith Golding represented the local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department.

Decision: By unanimous vote the Board voted in favor of the appellant and ordered Trumbull Police to issue the permit.

4) Case No. 17-123-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Captain Lawrence Terra represented the local Issuing Authority, Chief Chris Arciero, Canton Police Department with 3 witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

5) Case No. 17-177-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. . A representative failed to appear for the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Withdrew: Appellant withdrew his case.

6) Case No. 17-119-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  A representative Captain Craig Hall appeared for the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department.

Motion: Secretary Col. Kyle Overturf made a motion for the local  Issuing Authority by default due to the Appellant failure to appear, seconded by Board Member Johnson. Motion carried unanimously.

7) Case No. 17-252-CD, involving the pending decision of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear and the Boards decision to mark this matter off as Norwich has agreed to issue the permit once the appellant is in state.  Sgt. Joseph Peperni represented the local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Decision: Mark this case off as Norwich will issue when AP is no longer deployed.

8) Case No. 16-463-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.  Det. Brianna Tassinari represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Kyle Overturf made a motion for the state Issuing Authority by default due to the Appellant failure to appear, seconded by Board Member Johnson. Motion carried unanimously.

9) Case No. 17-214-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Counsel Joseph Skully represented the local Issuing Authority, Chief James Wardwell, New Britain Police Department with one witness.

Decision: By majority vote the Board voted in favor of the appellant and ordered New Britain Police to issue the permit. Chief Rosensweig and Ms. Johnson voted against the appellant.  Chairman Blando, Secretary Col. Kyle Overturf, Atty. Carolyn Futtner, Mr. Peter Kuck, and Dr. William Sledge voted in favor of the appellant.

10) Case No. 17-113-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Sgt. Hector Cardona representative appeared for the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Continued: Case has been continued to January 11, 2018.

 

Secretary’s Report:

Board member Col. Overturf made a motion to accept the November 30, 2017 minutes as submitted, Chief Rosensweig seconded the motion, motion carried. Ms. Johnson and Mr. Kuck abstained from the vote.

 

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Col. Overturf seconded the motion, motion carried. Meeting ended at 2:25pm.
